CORPORATION OF THE TOWN OF PETAWAWA
BY-LAW # 83/99
BEING A BY-LAW TO PROHIBIT OR REGULATE THE DISCHARGE OF FIREARMS IN THE TOWN OF PETAWAWA
WHEREAS the Municipal Act, R.S.O. 1990, Chapter M.45 Section 210 (36), provides that the councils of local municipalities may pass by-laws for the purpose of public safety, for prohibiting or regulating the discharge of guns or other fire arms, air guns, spring guns, cross bows, long bows or any class or type thereof in the municipality or in any defined areas thereof.
NOW THEREFORE the council of the Corporation of the Town of Petawawa enacts as follows:
1. Definitions
For purposes of this by-law:
(a)
BUILDING – shall mean any structure used or designed to be used for residential, commercial industrial or institutional use and any accessory building thereto, but shall not include a hunt camp.
(b)
FIREARM – shall include any device that discharges a projectile by means of gun powder excluding construction devices.
(c)
HUNT CAMP – shall mean a structure intended to provide basic shelter and accommodation on an occasional basis for a person or persons engaged in hunting or fishing activities.
(d)
IMPROVED STREET – shall mean a street or road which is maintained year round by the municipality, County of Renfrew or Province of Ontario.
(e)
MUNICIPALITY – shall mean the Corporation of the Town of Petawawa.
2. No person shall discharge a firearm in the municipality in any of the following defined areas:
(a) within 150 metres (492 feet) of any building
(b) within 50 metres (164 feet) of any improved street
(c) from any property owned by the municipality
3. This by-law does not apply to:
(a) any police officer, as defined in the Police Service Act, while in the conduct of his/her duties.
(b) on any Canadian Forces Base Petawawa Property
(c) Any animal control officer of the municipality while in the conduct of his/her duties
4. In addition to any other penalty or remedy available at law, every person who violates any provision of this By-law shall, upon conviction, be guilty of an offence and subject to such fines or penalties as may be imposed under the provisions of the Provincial Offences Act, R.S.O. 1990, c.P.33, as amended.
5. By-law # 476/64 of the Township of Petawawa is hereby repealed.
6. This By-law shall come into force and take effect upon the date of the final passing thereof.
