BEING A BY-LAW TO AMEND BY-LAW 71/98

BEING A BY-LAW RESPECTING CONSTRUCTION, DEMOLITION AND CHANGE OF USE PERMITS AND INSPECTIONS

WHEREAS the Building Code Act, S.O. 1992, c.23, as amended, provides that Municipal Councils may pass by-laws requiring the payment of fees and prescribing the amounts of the fees, on application for and on issuance of permits, and the total amount of the fees authorized must not exceed the anticipated reasonable costs of the municipality to administer and enforce this Act in its area of jurisdiction;

AND WHEREAS the Town of Petawawa has given notice of the proposed changes in fees and held the legislated public meeting;

AND WHEREAS the Council of the Corporation of the Town of Petawawa deems it expedient to amend the fees contained within By-law 71/98 being a by-law respecting construction, demolition and change of Use permits and inspections;

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PETAWAWA ENACTS AS FOLLOWS:

  1. That the existing Schedule “A”, CLASSES OF PERMITS AND PERMIT FEES, attached to By-law 71/98 be removed in its entirety and deleted.
  2. That Schedule “A”, CLASSES OF PERMITS AND PERMIT FEES, attached hereto, be inserted as the new Schedule “A”, CLASSES OF PERMITS AND PERMIT FEES, to By-law 71/98.
  3. That the fees contained in Schedule “A” shall come into force and take effect on January 1, 2020.
  4. That the fees imposed pursuant to this by-law shall be adjusted annually on January 1, without amendment to this by-law, in accordance with the Statistics Canada Quarterly, Construction Price Statistics, catalogue number 62-007.
  5. That this by-law shall come into force and take effect following third reading.

CLASSES OF PERMITS AND PERMIT FEES

(a) Construction: New Building, additions, mezzanines
Group A: Assembly $1.04/sq ft.
Group B: Institutional $1.10/sq. ft.
Group C: Residential
Single Family, Semi, Row, Townhouse, Duplex Dwelling $1.00/sq ft.
Apartment Building $0.52/sq. ft.
Hotel/Motel $1.10/sq. ft.
Residential Care Facility $1.10/sq. ft.
Group D: Business and Personal Services
Office Building $1.10/sq. ft.
Group E: Mercantile
Retail Store $1.10/sq. ft.
Group F: Industrial
Warehouse/Factory $1.10/sq. ft.
Farm Building $0.42/sq ft.
Garage/Carport/Shed $0.52/sq. ft. (Minimum $100.00 fee)
Deck or Pool $0.45/sq. ft.
Foundation $0.42/sq ft. (Minimum $100.00 fee)
(b) Interior Finishes: Finishes to previously unfinished area (including finishing of residential basement and major renovations) $0.42/sq. ft. (Minimum $100.00 fee)
(c) Alterations/Renovations: Alterations and renovations to existing finished areas $0.42/sq. ft. (Minimum $100.00 fee)
(d) Minor Alterations: Single partitions, washrooms, new entry and minor demolitions $0.42/sq. ft. (Minimum $100.00 fee)
(e) Special Categories: Demolition $150.00
Change of Use $300.00
Fireplace/Woodstove (each) $100.00
Starting without a Permit – Administration Fee $300.00
(f) Sewage System Permit $350.00
*Fees will be subject to review in 2023.

INTERPRETATION:

  1. Where the fee calculations is based on a monetary amount per square foot and the amount calculated totals less than $100.00, a fee of $100.00 shall be paid.
  2. In the case of interior alterations or renovations, area of proposed work is the actual space receiving the work (e.g. tenant space).
  3. Mechanical penthouses and floors, mezzanines, lofts, habitable attics and interior balconies are to be included in all floor area calculations.
  4. Unfinished basements for single family dwellings (including semis, duplexes and townhouses, etc.) are not included in the floor area.
  5. Attached garages and fireplaces are included in the Permit fee for single family dwellings.
  6. The Chief Building Official shall determine fee for classes of permits not described or included in this Schedule.
